Because the Appellant has also filed a discrimination complaint with the Massachusetts Commission Against Discrimination (MCAD), the Commission is dismissing this appeal until the MCAD has issued a final decision on the Appellants complaint. Should the Appellant wish to re-open his appeal with the Commission at that time, this Order, entered in response to a motion in limine by DOC, provides a framework for the issues to be considered.
