DOR's Conduct It is undisputed that on April2, 2018, DOR transferred Mary Bissonnette from the Fall River, MA DOR office (less than 10 miles from her home in Somerset) to the Chelsea, MA DOR office (more than 50 miles from her home in Somerset and entailing a minimum daily commute of four hours) ((Exhibit III: Initial Filing- Union Exh.4: Notice of Return to Work and lack of agreement to transfer; Exhibit I: Affidavit of McGoldrick, para. 12).
rights including the following: e First, DOR issued a formal warning on November 22, 2016, accused me of violating DOR policy and threatening termination (Exhibit 2: Formal Warning); e Second, DOR placed me on administrative leave (fitness for duty) on October 27, 2017 (Exhibit 3: Notice of Fitness for Duty Leave); e Third, on April 2, 2018, DOR transferred me from the Fall River, MA DOR office (less than 10 miles from my home in Somerset) to the Chelsea
On November 7, 2016 Bissonnette was notified that she would need to attend training from 9:00AM to 4:00PM in Chelsea, MA on November 16, 2016 & November 17, 2016. This training was also attended by her Tavares, and other departmental staff. On November 16th, Bissonnette arrived late for training and left at its conclusion.
