By midDecember, 2021, Bostons positive test rate reached 6.7%, and the BPHC expected a significant increase in COVID-19 cases following Christmas and New Years gatherings. Dr.
Bisola Ojikutu (Ojikutu), in her capacity as the Executive Director of the Boston Public Health Commission (BPHC) and Chair of a new COVID-19 Advisory Committee,6 advised the City that due to the emergence of the new and more contagious Omicron variant of the COVID-19 virus, testing alone would no longer be sufficient to avoid the virus spread.

As noted above, NAGE argues that its add-on election petitions satisfy these Standards because they include all positions of a similar nature, with a sufficient showing of interest, there is a community of interest between the petitioned-for employees and other Unit 6 employees, and there was never a reason to exclude these employees from Unit 6.
