The main method by which the Commission and the Human ResourcesDivision (HRD) ensure the application of basic merit principles in the hiring and promotional process is through the use of civil service exams and eligibility lists. 15 The eligibility lists are compiled, except for preferences, mainly on the basis of civil service examination scores. However, the competing candidates must first pass the exam before they receive consideration.

The City, using the authority delegated by the states Human ResourcesDivision (HRD) to all civil service communities, created a Certification with the names of the top three candidates on the eligible list. Two candidates, including the Appellant, signed the Certification as willing to accept appointment. The third candidate on the Certification notified the City that he was not willing to accept the appointment.
On September 1, 2019, the Appellants name was placed on an eligible list of candidates established by the states Human ResourcesDivision (HRD) for Stoneham Police Officer. (Stipulated Fact) 24. On September 27, 2019, HRD issued Certification No. 06680 to the Town of Stoneham from which the Town was authorized to appoint two candidates from the first five candidates willing to accept appointment.
