In Lecorps v Department of Correction, G1-12-207 (December 19, 35 2013), the Appellant appealed his bypass based on a hair drug test in which he tested positive for marihuana. The Appellant averred that he innocently ingested marijuana when he ate pastries at a party prior to the drug test. The Commission found, it is simply not credible that he ingested marihuana without knowing it.

The pilot program of one mobile phone in light of the recent Department of Correction inspection was a core managerial decision and thus bargaining was not required. Additionally, the pilot program did not alter the terms and conditions of employment at the HOC. Any change was de minimus at best. This situation is comparable to the facts in Commonwealth of Massachusetts, 17 MLC the complaint filed by NAGE 1282 (1990).
