Nadworny: This office has received your email appealing the response of the Massachusetts Parole Board (Board). Specifically, you requested a copy of a testimony concerning an identified individual. After reviewing this information, I find that I am unable to accept your appeal.
On October 16, 2020, Appellant Benjamin Mahan (Mahan), a Field Parole Officer A/B (FPO A/B) at the Massachusetts Parole Board (MPB), filed an examination appeal with the Civil Service Commission (Commission).1 2. In its response, the Division asserted, [i]n this case, MGL Chapter 127 154 specifically notes that the records created by the Parole Board acting as the Advisory Board of Pardons are considered permanent records open to public inspection at any reasonable time for a period of ten years from the date the original petition was filed with the board (See also the Petition for Pardon form available online through the Massachusetts Parole Board which specifically
Pugatch states in his February 16 letter to this office that the video of the incident was most recently used by the Parole Board in 2014, and that he was informed by the Parole Board that the video had been returned to the Department. Therefore, I find that the Department must conduct a diligent search for the video recording, or produce an approved destruction permission form for the period associated with the responsive record.
In February, 2012, Parole Board Chairman Wall unilaterally issued a document entitled Standardization of Case Audits (copy enclosed). This document unilaterally implemented additional changes to parole officer case standards beyond those already the subject of the Unions pending charge in SUP-12-1658. These additional changes affect mandatory subjects including workload, standards of productivity and performance, and standards of discipline.
