Requests for such gender-based selective certifications are carefully reviewed by both the Human Resources Division (HRD) and the Massachusetts Commission AgainstDiscrimination (MCAD) to ensure that such certification is valid and job-related.
Having received no satisfaction with my union, for which J was an officer, I opted to file a complaint with the Massachusetts Commission AgainstDiscrimination (MCAD) alleging that my termination and the manner in which I was treated prior to, was due to my disability. 14, In response to the complaint the Town filed a motion to dismiss claiming that as a result of the release which was part of the separation agreement that I was precluded from filing
Guidon filed claims of discrimination at the Massachusetts Commission AgainstDiscrimination (MCAD) against the Town. See Charge 13. The Town filed a motion to dismiss the claims of discrimination on or about July 19, 2016, alleging that Ms. Guidon released her claims of discrimination when she 2 signed the Separation Agreement . The MCAD rendered a decision on November 7, 2016, dismissing the charges of discrimination against the Town.
On June 28, 2016, Couture filed a complaint with the Massachusetts Commission againstDiscrimination (MCAD) alleging that the Town discriminated against her on the basis of her disability when it terminated her from employment. On July 19, 2016, the Town filed a Motion to Dismiss with MCAD (Motion to Dismiss) arguing that Coutures filing of the complaint was precluded by the terms of the Agreement.
The Town provided a response to this office on July 22, 2021 verifying a pending matter with the Commission AgainstDiscrimination (MCAD) relating to the subject of Ms. Vicinos request. See Vicino v. Town of Carver, et al. (MCAD Docket No. 19NEM02884). Conclusion In light of the pending administrative matter, I decline to opine on this matter. See 950 CMR 32.08(2)(b). Accordingly, this administrative appeal is closed.
