Moreover, the Town has effectively implemented a new policy, without bargaining with the Union, that allows for the discipline and/or discharge for any employee who is deemed in violation of said policy (See City of Lowell, 28 MLC 126 (2001); City of Peabody, 9 MLC 1447 (1982)). This panopticon style of surveillance of bargaining unit members is a violation of Section 10(a)(5), and derivatively Section 10(a)(1) of the Law. 8.
