In a civil case, the Massachusetts courts have held that even a party asserting his or her rights against self-incrimination under the U.S. or Massachusetts Constitutions may be the subject of a negative inference by a fact finder where the opposing party has established a case adverse to the person invoking the privilege.

Although the services rendered in the homes are provided by the Department, the homes located in the City of Boston are owned by the Boston Housing Authority (BHA). Each home is staffed 24 hours per day by three (3) shifts of Direct Support Workers (DSW) who receive direct supervision from the Residential Supervisor (RS) that is assigned to that particular home.

They have been successful in housing over 200 families in Boston with their success being highly dependent on the permanent housing resources to which the group has access.
