On or about September 3, 2015, HRD issued Certification #03219 to Worcester for the appointment of thirty Firefighters. The Certification contained eight names with statutory preference and approximately 110 other names, all of whom claimed Worcester residency preference.
Based on the statement of the parties and the documents submitted by the states Human ResourcesDivision (HRD), the following appears to be undisputed: 1. In April 2008, the Appellant took and passed an examination for the position of firefighter. At the time, the Appellant was living at 89 Sawmill Road in Springfield, MA. 2. In December 2008, HRD established an eligible list of candidates for Springfield firefighter.
Smiths name was placed on an eligible list of candidates for police officer in Holyoke by the states Human ResourcesDivision (HRD). Said eligible list was established on November 1, 2011. In August 2013, the City requested a Certification to appoint fifteen (15) reserve police officers. On August 2, 2013, HRD sent Certification No. 01035 to the City.
Sexton appealed DOR/CSEs determination to the states Human ResourcesDivision (HRD). 4. On October 29, 2015, HRD denied Ms. Sextons appeal and affirmed DOR/CSEs decision to deny her request for reclassification. In the denial letter issued to Ms. Sexton, she was informed of her right to file an appeal with the Civil Service Commission (Commission). 5. The above being said, the Commission reiterates its longstanding admonishment to Appointing Authorities and the Human ResourcesDivision to end the unhealthy and improper reliance on provisional appointments and promotions. See Sullivan v City of Boston, G2-06-48 (2007). Conclusion For the above reasons, the Appellant is not a permanent Civil Service employee and is therefore not entitled to hearing rights under Section 43.
