The point, applied here, is that Ms. Harvey could not have been expected to know whether HRD had delegated this Section 40 responsibility to cities and town. Further, when she did contact HRD, she was told to submit her request to the City, which she did almost immediately and well within the two-year statutory timeframe for filing such a request.
