Town of Oak Bluffs, 419 Mass, 227, 233 (1994) (quoting Restatement (Second) of Judgments 27 (1982)). Here, the Commission will not re-litigate the Appellants appeal under CSC Case No. G-3631. Rather, the Commission is guided by the plain language of its June 8, 1998 decision in that matter which states: The Civil Service Commission decided the appeal based on the mutual agreement of the parties, which is incorporated into this decision.

As the CERB explained in Town of Oak Bluffs and Oak Bluffs Professional Firefighters, MUP-17-6101 (Review of Probable Cause Decision, slip op. May 24, 2018),3 its longstanding practice is to plead these Section 10(a)(1) violations as derivative rather than independent violations to avoid unnecessary confusion and duplication.
