Summary
This is a Public Records Act request for the following records, in whatever form they may exist, including without limitation paper, electronic, video, or otherwise: 1. all records concerning the basis of the June 2, 2023 Conservation Commission Notice of Violation to Arthur Genova (the "NOV") and/or any underlying complaints that were not included in the package provided by Conservation Commission staff to Mr. Genova on June 20, 2023, including without limitation: • the maps referenced as attached in Kim Lowe's email dated May 10, 2023 to Randy Parker at landmanagement@comcast.net et al.; • the map referenced as attached in Steve Cornell's email dated May 8, 2023 to to Randy Parker at landmanagement@comcast.net  et al.;  • the "small book" referenced in Randy Parker's email dated May 20, 2023 to Steve Cornell at stvcornell@aol.com et al.;  • the "requests for permit rescission" referenced in Steve Cornell's email dated May 13, 2023 to Randy Parker at landmanagement@comcast.net;  2.  the purported Request for Determination of Applicability, PCC-23-14R, submitted by Stephen Cornell and presently scheduled for public hearing at the Conservation Commission's July 18, 2023 meeting (the "Purported RDA") and all records concerning the Purported RDA, including without limitation Mr. Cornell's communications with Conservation Commission members and/or staff;  3. all records constituting or concerning communications to, from or among any members of, or staff assigned to or otherwise assisting, the Conservation Commission concerning Arthur or Patricia Genova, the NOV, the complaints underlying the NOV, and/or the Purported RDA during the period January 1, 2022 through to the present; 4. all records constituting or concerning communications to or from (a) any member of, or staff assigned to or otherwise assisting, the Conservation Commission and (b) any other person concerning Arthur or Patricia Genova, the NOV, the complaints underlying the NOV, and/or the Purported RDA during the period January 1, 2022 through to the present; 5. all documents constituting or concerning communications to or from (a) any member of, or staff assigned to or otherwise assisting, the Conservation Commission and (b) Stephen Cornell and/or Kim Lowe concerning Arthur or Patricia Genova, 14 Smaland Lane (Cornell property), 17 Smaland Lane (Genova property), Smaland Lane (Smaland Beach Association, Inc. property), 157 Little Sandy Pond Road (Satterlund property), and/or Island Pond or Crescent Road in the vicinity of the foregoing properties, during the period January 1, 2022 through to the present;  6. all documents constituting or concerning communications to, from or among any members of, or staff assigned to or otherwise assisting, the Conservation Commission concerning Arthur or Patricia Genova, 14 Smaland Lane (Cornell property), 17 Smaland Lane (Genova property), Smaland Lane (Smaland Beach Association, Inc. property), 157 Little Sandy Pond Road (Satterlund property),  and/or Island Pond or Crescent Road in the vicinity of the foregoing properties, during the period January 1, 2022 through to the present;  7. any and all disclosures by Randy Parker of provision by him or his company of services to or on behalf of Steve Cornell, Kim Lowe, Carol Mahoney, Smaland Beach Association, Inc., and/or any other person or entity whom Mr. Parker believes is or may be associated with Smaland Beach Association, Inc. and/or is otherwise adverse to Arthur Genova; 8, minutes for the Conservation Commission meetings held on May 2, May 9, and May 16 2023; and 9. the Zoom videos for any of the Conservation Commission meetings held on May 2, May 9, May 16, May 23, May 30, June 6, June 13, June 20, 2023, and June 27 at which there was comment by Steve Cornell, Kim Lowe, or any mention of Arthur or Patricia Genova, 14 Smaland Lane (Cornell property), 17 Smaland Lane (Genova property), Smaland Lane (Smaland Beach Association, Inc. property), 157 Little Sandy Pond Road (Satterlund property), and/or Island Pond or Crescent Road in the vicinity of the foregoing properties.   Please send me the requested materials by email or let me know when they are available to be picked-up, preferably reasonably in advance of the July 18 public hearing on the Purported RDA. Please provide the documents on a rolling basis if needed to avoid further prejudicing the Genovas, who are the subject of the Purported RDA, given that they only received notice of the Purported RDA and the July 18 hearing two days ago, Saturday, July 8.  As to categories 8 and 9, the records alternatively may be uploaded to the Town's Minutes/Agendas website and you may let me know when they have been loaded, as I may review them there.  Attached is the information we have on file related to your request. The Town has redacted personal e-mail addresses and personal phone numbers because its disclosure would constitute an unwarranted invasion of personal privacy not outweighed by the public’s interest in disclosure of the material. These redactions have been made to the record only where necessary and no whole pages have been redacted.
