The email body and attachments to the  11/9/21 and 12/6/2021 emails from Petrini and Associates have been redacted/withheld from this response as it is legal advice that was given in confidence to the City staff by the City Solicitor’s Office, the privilege for which has not been waived.  Such records are privileged attorney-client communications which are exempt from disclosure under the common law attorney-client privilege recognized in Suffolk Construction v. DCAM, 449 Mass. 444 (2007).  Attachments related to Executive Session minutes for the School Committee are also being withheld per exemption (a) and G.L. c. 30A, s. 22(f) – executive session materials/minutes may be withheld in response to a public records request “as long as publication may defeat the lawful purposes of the executive session”.  These concern School Committee Executive Sessions for which the minutes have not yet been approved for release to the public by the School Committee. As per previously established practice under the direction of legal counsel and the Secretary of the Commonwealth’s Division of Public Records office, the home contact, health and medical, and / or family information, as well as other details of a sufficiently personal nature, etc. have been redacted under the following exemption(s): Exemption (c) personnel and medical files or information; also any other materials or data relating to a specifically named individual, the disclosure of which may constitute an unwarranted invasion of personal privacy G. L. c. 4, § 7(26)(c). You have a right to appeal this response by filing an appeal with the Supervisor of Public Records or filing an action in Superior Court pursuant to G.L. c. 66, s. 10A.
