Dear Records Access Officers: Under the Massachusetts Public Records Law, I am requesting data, preferably in .csv, or .xlsx format, pertaining to 911 calls to the congregate care facilities listed below, from Jan. 1, 2010, or the earliest date that is exportable, through the date upon which the data for this request is generated. The calls should include calls routed to all agencies, such as police, fire, and EMS. ***Note: I previously made a request for similar data for Wayside’s campus (#2021-1179). The data was provided by the police and fire departments. The data for this new request can be provided in exactly the same way. List of congregate care facilities ? Brandon School and Residential Treatment Center - 1224 Edgell Rd ? Eliot - 569 Salem End Rd ? JRI - 46 Lanewood Ave ? LCDC - 80 Kellogg Street ? NECC - 110 Parker Rd ? NECC - 257 Temple St ? NECC - 28 Francine Rd ? NECC - 947 Salem End Rd List of database fields requested This data should include a record for each incident, and all fields that contain non-exempt information, including but not limited to the following information: ? All unique identifiers (i.e. call number and/or incident ID) ? Time and date of the call ? Location of call ? Nature of the call ? Number and type of dispatched units ? Outcome of call ? Priority level of the call If one or more of the fields I requested above is not available in the 911 database(s), please notify me via email and I will strike that field from my request. I am merely asking for the non-exempt fields maintained in the 911 call and dispatch database(s), regardless of whether I’ve listed the exact field or not. Database documentation requested I am also requesting any data dictionaries, glossary of terms, record layouts, etc. pertaining to the above database(s), that describe the database and define the fields and codes used in the database. Requested format and other provisions I would like to receive this information in machine-readable data table format, such as .CSV or .XLSX, which I am entitled to under 950 CMR 32.07(d). (“The records access officer must provide electronic records in native form when possible.”) In contracting or creating a database, agencies are obligated under 950 CMR. 32.07(e)(1, 2) to ensure that the database is “capable of providing data in a commonly available electronic, machine readable format,” and “allows for … retrieval of public portions of records to provide maximum public access.” Further, as described in 950 C.M.R. 32.07 (f), “furnishing a segregable portion of a public record shall not be deemed to be creation of a new record. This applies to a responsive record in the form of an extract of existing data, as such data exists at the time of the request and is segregable from non-responsive and exempt data.”  As a member of the media reporting on matters in the public interest, I am requesting a fee waiver and an expediting of my request. Since I am requesting records in their original electronic format whenever possible, I expect the costs, if any, to be limited. Please notify me in advance if the fee will exceed $50. G. L. c. 66, § 10(a) requires that you fulfill my request within 10 business days. If you are unable to do so, you are required to send me a written response within that timeframe that includes the information outlined in G. L. c. 66, § 10(b)(i-ix). If you deny any portion of my request, G. L. c. 66, § 10(a-b) requires that you send a written denial that details the specific basis for withholding the material, cites the statutory or common law exemptions, and advises me of the administrative process and judicial remedies for appeal. If you redact any fields in the database, please cite the specific exemptions you are applying to each field. I ask that communication regarding this request be conducted via email, and that the request be filled via email, which I am entitled to under the law. The Department intends to withhold/redact the above-referenced requested records due to the applicability of the following exemptions and the reasons set forth below. Exemption (a):  This exemption applies to records that are "specifically or by necessary implication exempt from disclosure by statute."  DOMESTIC ABUSE & SEXUAL ASSAULT CASES In particular, G.L. c. 41, section 97D requires law enforcement agencies to keep the following information confidential.  Section 97D provides that "All reports of rape and sexual assault or attempts to commit such offenses, all reports of abuse perpetrated by family or household members, as defined in section 1 of chapter 209A, and all communications between police officers and victims of such offenses or abuse shall not be public reports and shall be maintained by the police departments in a manner that shall assure their confidentiality; provided, however, that all such reports shall be accessible at all reasonable times, upon written request, to: (i) the victim, the victim's attorney, others specifically authorized by the victim to obtain such information, prosecutors and (ii) victim-witness advocates as defined in section 1 of chapter 258B, domestic violence victims' counselors as defined in section 20K of chapter 233, sexual assault counselors as defined in section 20J of chapter 233, if such access is necessary in the performance of their duties; and provided further, that all such reports shall be accessible at all reasonable times, upon written, telephonic, facsimile or electronic mail request to law enforcement officers, district attorneys or assistant district attorneys and all persons authorized to admit persons to bail pursuant to section 57 of chapter 276. Communications between police officers and victims of said offenses and abuse may also be shared with the forgoing named persons if such access is necessary in the performance of their duties. A violation of this section shall be punished by imprisonment for not more than 1 year or by a fine of not more than $1,000, or both such fine and imprisonment.”
