Massachusetts Public Records Law authorizes
withholding of, “personnel and medical files or information; also any other
materials or data relating to a specifically named individual, the disclosure
of which may constitute an unwarranted invasion of personal privacy.” G.L.
c. 4, § 7(26)(c) -- under this provision the city is withholding 3 records for
medical, and 1 for personnel. Under this same provision for personal
privacy the city has redacted some email addresses, cell phone numbers,
passwords, and ages/names of minors when known.
The City is withholding 10 communications with
the City Solicitor’s Office made in confidence between the City and its counsel
for the purposes of seeking/giving legal advice which is upheld under the
common law attorney-client privileged recognized in Suffolk Construction v.
DCAM, 449 Mass. 444 (2007).
