Student names and addresses on the household worksheet have been withheld from this response pursuant to G.L. c. 4, s. 7(26)(a), which applies to records that are “specifically or by necessary implication exempted from disclosure by statute.” Under the Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. § 1232g, and Massachusetts Department of Elementary and Secondary Education regulations, 603 CMR 23.00 et seq, the City is prohibited from disclosing personally identifiable information (PII) from students’ education records. Education records are records that are directly related to a student and maintained by an educational agency or institution or by a party acting for the agency or institution. See 34 C.F.R. § 99.3. PII includes direct identifiers such as a student’s or other family member’s name and home address. Id. The Excel spreadsheet providing details on the FPS households to whom Chromebooks were issued for the FPS remote learning program is an education record as it falls within this definition, and the students and family member names and contact information, which are PII under both state and federal law, were withheld from the response.
