The City shall indemnify employees from personal financial loss and expenses, including legal fees and costs, if any, in an amount not to exceed $1,000,000.00 arising out of any claim, action, award, compromise, settlement, or judgment by reason of an intentional tort or such act or omission was action within the scope of his/her official duties.
Indemnification under Section A and B above is subject to the provision contained in Chapter 258 of the Massachusetts General Laws that the defense or settlement of any action or claim for which indemnification is sought shall have been made by the town counsel or legal counsel for the district upon request of the Committee; or, if the town has no town counsel or the district has no legal counsel, by an attorney employed for such purpose by the Committee
The plan shall contain all of the positions, by title, which are covered by this Agreement setting forth the rates of pay therefor, which shall include the one time increase of $200.00 to each OCC step effective 7/1/19 to reflect the settlement of the vision care issue. B. SHIFT DIFFERENTIAL All employees regularly assigned to work the second shift shall be paid, in addition to their regular pay, a differential of six percent (6%).

The terms of the five previous settlement or side agreements appended hereto shall continue in full force and effect, save for any provisions in direct conflict with new language in this agreement and save for the provisions relative to payment of an individual that have already been fulfilled.
