Specifically, Mr. Sinni, Jr. requested four (4) categories of records regarding newly implemented procedures to be followed when responding to public records requests. Having received no response, Mr. Sinni petitioned this office.
However, you have maintained that the public has a reasonable expectation that posted documents represent the actual documents used at the meeting because the Town ofActon has established a precedent by providing a link to Materials used at this meeting. We are constrained to enforce the Open Meeting Law as written; we cannot establish new responsibilities based on a public bodys past practice.
During the March 27, 2017, meeting, the Board discussed initiating litigation against the Town ofActon to appeal certain conditions imposed with respect to a special permit. The Board did not discuss Estabrook Road during either meeting. On March 11, 2019, the Board approved for release the minutes of these two meetings.
