In the event no settlement is reached then the grievance, in writing, will be submitted to an impartial arbitrator whose decision will be final and binding on the parties. Should the parties be unable to agree on an arbitrator, either party may request a list of arbitrators from the American Arbitration Association. The arbitrator shall have the authority to decide the issue presented in the grievance.

All settlements of grievances shall be consistent with the terms of this contract. Level 1.- An Administrator must file a grievance within 10 days of its occurrence with the Superintendent-Director. Within 14 days of filing the Superintendent-Director or Principal must meet with the Administrator and the Union representative and make his/her decision. The written decision must be sent to the Union within 7 days of said meeting. Level 2.

If the Union and the Authority are unable to agree as to the settlement of the case, then it may be referred to the grievance machinery, as set forth in Article VIII, within five (5) days after the above notice of appeal is given by the Union to the Authority. The Article is also subject to Chapter 31, sections 43 and 45 of the General Laws of the Commonwealth of Massachusetts. SECTION 6: Probationary Period.
