If the complaints are not resolved to the satisfaction of one-third (1/3) of all full-time members of the department who are eligible to participate, the concerned members shall next meet informally with the Vice President to discuss the matter and obtain the Vice Presidents assistance in reaching an informal settlement of such complaints.

Lazarus erroneously believes Armstrong entered into a Last Chance Agreement at this time as part of the resolution; however, Armstrong never agreed to the terms of a Last Chance Agreement as part of the settlement in the Spring of 2019. The evidence reveals Armstrong voluntarily sought counseling from the Towns Employee Assistance Program. Armstrong testified he found this program helpful.
