School Committee to who m the Subcommittee agrees to recommend acceptance, and the Negotiating Team of the American Federation of State, County and Municipal Employees, Council 93, Local 2977 (Custodial Unit}, ( herein after the Union ), acting subject to the ratification of this Agreement by the me mbership of the Union to whom the Negotiating Team agrees to recommend acce ptance, hereby mut ually agree to the following terms and conditions of settlement

Ifno satisfactory settlement of the grievance is made, it may: D. Be appealed to arbitration by written notice of such intention to appeal within fifteen (15) working days after the receipt of the written answer under Step C is due. This appeal to arbitration shall be in accordance with the procedure and conditions in Article VII. A grievance not initiated within the time specified shall be deemed waived.

Step 3: Ifthe grievance or dispute remains unsettled after Step 2, either party may, within thirty (30) days after the reply of the Board of Selectmen or designee is due, submit the grievance or dispute to the American Arbitration Association or the Division of Labor Relations for settlement according to its procedures. 4.

However, the School Committee agrees only to hear such person and to make no settlement; rather to refer such employee to the agreed upon grievance procedure. ARTICLE VI Job Posting and Bidding When a position covered by this Agreement becomes vacant and is to be filled, such vacancy shall be posted within forty-eight (48) hours after such vacancy occurs.

Upon receipt of such notice, the parties shall make mutually satisfactory arrangements to engage in negotiations leading to a settlement of issues raised by such notice with the goal of completing the negotiations on a new agreement by January 15, 2017. Nothing in this Article shall preclude either the Employer or the Union from modifying any proposals made during the course of the negotiations.

Any settlement of a grievance at Step 1, Step 2 or Step 3 shall not constitute a precedent. Step 4. If the grievance remains unsettled, either party may, within 21 calendar days after the reply of the Manager is due, by written notice to the other, request arbitration, 2.

The following represents the agreed upon wage settlement for this contract term. a. . c. The existing Wage Schedule and the longevity schedule will be merged thus eliminating longevity. The new scale will consist of the following steps: 1, 2, 3, 4, 5, 10, 15, and 20. Salary increases will be as follows: 1% in July 2016, 1% in July 2017, and 1% in July 2018.

The following represents the agreed upon wage settlement for this contract term. a. The existing Wage Schedule and the longevity schedule will be merged thus eliminating longevity. The new scale will consist of the following steps: 1, 2,3, 4,5, 10, 15, and 20. b. c. Salary increases will be as follows: 1% in July 2016, 1% in July 2017, and 1% in July 2018.

(e) The gnevance procedure and the arbitration provided for herein shall constitute the sole and eaclusive method for the determination. adjustment, or settlement of the Unions grievances. 69) A grievance not initiated within the time specified shall be deemed waived.

Time lost by representatives of the Union on grievance settlement or negotiations shall be paid for by the City as follow s: A. For Grievances No more than two Union members, being the Stewa rd and the employee involved, may process the grievance and, in any instance, twenty-four hour notice is required except for emergencies or matters requiring immediate attention.
