There is no suspicious timing, history of antipathy toward union activities, disparate treatment, or deviation from past practices. There is also no nexus between Lymans general duties as SLEA President and his suspension.

Timing City of Malden, alone is insufficient to establish unlawful employer 5 MLC 1752, 1764, MUP-3017 (March 20, 1979). The Town argues that there is no direct evidence of discrimination and that the circumstantial evidence is scant and insignificant. It further argues that timing is not a factor because the verbal warning occurred several months after Kivlans resignation as Union president and the promotions were even more remote in time.
