DeRosa: I have received your petition appealing the response of Department ofAgriculturalResources to your request for public records. The requirements for an appeal are follows: Such appeal shall be in writing, and shall include a copy of the letter by which the request was made and, if available, a copy of the letter by which the custodian responded.
Bernstein: I have received your petition appealing the April 23, 2014 response of the Department ofAgriculturalResources (Department) to your request for public records. G. L. c. 66, 1O(b) (Supervisor of Public Records has authority to resolve public records appeals); see also 950 C.M.R. 32.08(2) (appeal process). Specifically, you requested a copy of: 1.
Department ofAgriculturalResources, 477 Mass. 280, 292(2017). Although this was a misconduct investigation, the witnesses and victims were attending a wedding or part of a wedding party and disclosure of the names many cause an unwarranted invasion of privacy to the bride and groom. Asa result, such information must be withheld/redacted under the law.
Rocheleau further notes, "*Subagencies including but not limited to the: Department of Environmental Protection, Department of Public Utilities, Department of Fish and Game, Department of Energy Resources, Department of Conservation and Recreation, Department ofAgriculturalResources, Massachusetts Environmental Policy Act Office, and Massachusetts Environmental Police."
