In its letter dated February 3, 2012, the Department of Labor Relations directed the CMEA to file a motion to intervene within 30 days of receiving the letter pursuant to Department Rule 456 CMR 12.03. Department Rule 12.07 sets forth a presumption that a notice is received within three days of its issuance, but provides that the presumption may be rebutted by evidence of later receipt.
