The Unions excuse, that the employer committed a fait accompli without bargaining, is unsupported by any part of the Unions bare bones submission, and is in fact contradicted by the evidence that the issue was a topic for negotiations over a period of 18 months, including four months of mediation under the auspices of the J.L.M.C.
