While this appeal was pending, a representative from the Department notified this office that these records are the subject of investigation being conducted by the Attorney General's Office. Specificity Under the Public Records Law, the burden is on the custodian to prove with specificity the exemption which applies. See G. L. c. 66, lO(b)(iv); see also Globe Newspaper Co. v. Police Comm'r, 419 Mass. 852, 857 (1995); Flatley, 419 Mass. at 511.

After some further discussion it was revealed by me that Mayor Martin and I received a letter from the Attorney Generals office dated December 20, 2019 related to the John Zon Community Center. The letter revealed that the hired contractor failed to pay Prevailing Wage to its workers and was ordered to pay restitution and penalties equaling $998,944.88. P-Three was the OPM for that project and responsible for ensuring the PV was paid.

If the Attorney Generals Office investigation is still open, I would ask anything directly related to it be redacted. Considering one cant be tried for the same crime twice and [an identified individuals] OUI case has been adjudicated and was prosecuted by the AGs office, these records should not be exempt from public inspection in their entirety.
