Doing so could also decrease the possibility of any fair resolution of the matter through settlement. The Department would then have to litigate the matter to resolve it, which will delay resolution to the detriment of the public interest and will utilize significantly more Department resources, all of which runs counter to effective enforcement.

In addition, the Parties are directed to confer as to whether they are willing to engage the services of a DLR Mediator for possible settlement. Utilization of a mediator will not delay the commencement of the Hearing.
In one case the parties swept any underlying factual or legal disputes regarding hours of work, roll call pay and overtime for the period December 14, 1991 to June 20, 1995 into a bulk monetary settlement. JX # 10. A subsequent Grievance reflecting a Class Action was filed for the period since June 20, 1995. See Employer Ex. # 3A (December 11, 1997). Scheduling disputes, inconsistencies in the application of stop/start hours, were not litigated.
The first of these issues is that the Union believes that, in addition to the amount of the Local 419 settlement, its members are entitled to thirty minutes of overtime pay because they are working hours in addition to those required by the contract from June 21, 1995 to present.
Despite these consistent statements of position by the Sheriff that shifts for Captains were 8 % hours in length, and despite the financial settlement negotiated with the Sheriff, the Union then filed a grievance pursuant to the CBA grievance procedure on December 11, 1997 (ER#3A), alleging that the Sheriff had altered the terms of the CBA and violated the terms of the negotiated work schedule.
