The Attorney General'sOffice considers a document to be "used" at a meeting when it is, at a minimum, physically present, verbally identified, and its contents are discussed by members of the public body during an open session. See OML 2012-42; OML 2011-18.

See G. L. c. 66, 10A; see also 950 C.M.R. 32.08(1).
While neither the state's new Open Meeting Law nor the regulations issued by the Attorney General'soffice specify that votes taken, which is what we went by, those regulations, in executive session need to be voted in open session, however the recently issued guide issued by the attorney general's office calls for boards to do just that. . . This was the guide we did not follow.
The Homes July 2nd response In its July 2, 2020 response the Home indicates the number of investigations ongoing from the Governors independent investigation, which it notes has concluded, the federal Department of Justice (DOJ), Massachusetts Attorney GeneralsOffice (AGO), and Office of the Inspector General (OIG).
We understand that the Board responded to the complainant in a letter dated March 20, 2012, but failed to send a copy of its response to the Attorney General'sOffice as required by the Open Meeting Law.' See G.L. c. 30A, 23(b).
Committee member Matthew Tallon asked two other members why they had drafted a letter to the Attorney General'sOffice regarding an alleged Open Meeting Law violation.
