It is 9 inconceivable that the HO and CERB ruled as they did with this evidence of perjury by these four individuals in the record, committed by this recidivist-offender Respondent that was already under a Cease and Desist Order by the Massachusetts Commission Against Discrimination for retaliating against faculty. 10.
Bryan also filed charges with the DLR,one of which in particular the hearing officer took administrative notice.3 Bryan also filed a complaint with the Massachusetts Commission Against Discrimination addressing, amongst other things, the same issues that were raised in the instant matter.(See Respondent's Exhibit #1).
As further evidence of the retaliatory history of the Respondent, the Massachusetts Commission Against Discrimination in DOCKET NO. 05-BEM-02717 issued a Cease and Desist Order against Respondent for unlawful retaliation against a Bridgewater State University faculty member, in violation of M.G.L. c. 151B 4(4). Thus, and incredibly, the Respondent was willing to vigorously and unlawfully retaliate against Dr.
The University was the subject of a complaint for discrimination on the basis of age and unlawful retaliation at the Massachusetts Commission Against Discrimination. After public hearing, the MCAD found the University to have retaliated against the faculty member and an Order was entered that the University immediately cease and desist from engaging in unlawful retaliation.
