SECOND AFFIRMATIVE DEFENSE Under the States 2020 Police Reform Legislation, An Act Relative To Justice, Equity and Accountability In Law Enforcement In The Commonwealth, Chapter 253 of the Acts of 2020, and the mandate issued with the creation of the Massachusetts Peace Officer Standards and Training (POST) Commission, the City was obligated to provide POST with the information it submitted regarding the Officer and the Officers Internal Affairs History
On or about April 2022, the Employer provided documents to the Massachusetts Peace Officer Standards and Training Commission (POST Commission) showing that MC had been disciplined for nine allegations of misconduct related to the April 30, 2015 disciplinary charges, and that MC had been suspended for twenty days as a result of engaging in all nine instances of improper conduct. 9.
In or about April 2022, the City provided documents to the Massachusetts Peace Officer Standards and Training Commission (Post Commission) showing that Officer Clavette had been disciplined for nine allegations of misconduct, including an allegation of untruthfulness, related to the April 30, 2015 disciplinary charges.
