The Respondent is the largest secretariat in state government and is comprised of the Board of Registration in Medicine, the Department of Children and Families, the Department of Developmental Services, the Department of Mental Health, the Department of Public Health, the Department of Transitional Assistance, the Department of Veterans Services, the Department of Youth Services, the Executive Office of Elder Affairs, the Massachusetts Commission
At that time EOHHS Secretariat Labor Relations Director and Deputy General Counsel, Erica Crystal stated that an order was going to be issued by the Department of Public Health mandating EOHHS employees to receive the flu vaccine. The Employer explained that if an employee refused to receive a flu shot they would be suspended and ultimately terminated.
The Union is the exclusive bargaining representative for all full-time and part-time employees employed by the Commonwealth in job titles in statewide bargaining Unit 2, including employees employed at certain assisted living residences (ALR), long-term care facilities (LTCF), licensed adult day health programs and licensed out-of-hospital dialysis units (collectively, Congregate Care Facilities), Department of Public Health (DPH) Public Health Hospitals
