Department of Public Health, 482 Mass. 427 (2019). With respect to exemption (a), the decision of the Supervisor is affirmed. I will now reconsider my November 3rd determination with respect to Exemption (c) in accordance with the Court's December 4th decision in Somerville.
Department of Public Health, 482 Mass. 427 (2019). On March 12, 2020, I issued a determination ordering the City to submit additional information addressing the factors, concerns, and issues described in Justice Henrys December 4th decision.
In a recent Superior Court ruling, the court found that the public's interest in disclosure of birth, death and marriage indexes by the Department of Public Health (Department) did not outweigh the invasion of privacy of the substantial number of people whose information was contained in the indexes because the requestor could conduct the research to determine whether David Shapiro, Esq.
