Exclusions; Notwithstanding any provisions of this Agreement, any matter which is subject to the jurisdiction of the Civil ServiceCommission or any Retirement Board established by law or where the employee otherwise has statutory rights, or any dispute relative to wages which is subject to the jurisdiction of the Commissioner of the Department of Labor and Industries or any other state or federal agency, shall not be a subject of arbitration hereunder
Subject to the provisions of Chapter 150E of the General Laws, nothing in this Agreement shall diminish the authority and power of the Civil ServiceCommission, any Retirement Board or Personnel Board established by law. ARTICLE 24 EFFECT OF AGREEMENT (a) This Agreement contains and constitutes the entire Agreement between the Town and Local 1706 arrived at as a result of collective bargaining.

Any employee wishing to appeal a disciplinary action taken pursuant to Article 23 of this Agreement, must sign and submit to the Employer, on a form prepared by the Employer, a confirmation that the employee has not appealed said disciplinary action to any other forum, including but not limited to the Civil ServiceCommission, Massachusetts Commission Against Discrimination and the Equal Employment Opportunity Commission.
Any matter which is subject to the jurisdiction of the Civil ServiceCommission or Retirement Board established by law shall not be subject to the grievance and arbitration provisions of this Agreement. Complaints by Civil Service employees that they are being required to work outside their job descriptions shall be referred to the Commissions Office of Labor Relations prior to making complaint to the Director of Civil Service. As acondition precedent to submitting a grievance alleging a violation of this Article, the Union and the employee involved shall sign and give to the Authority, on a form prepared by the Authority, a waiver of any and all rights to appeal the disciplinary action to any other forum including the Civil ServiceCommission.
