Section 5, Notwithstanding any provision ofthis Agreement to the contrary, any matter that is subject to the jurisdiction of the Civil ServiceCommission, or any Retirement Board, established by law, or where the employee otherwise has statutory appeal rights, or any dispute, relative to wages, that is subject to the jurisdiction of the Commissioner of Labor and Industries, or any other state or federal agency, shall not be a subject of arbitration
ARTICLE 10 - PROMOTIONS, VACANCIES AND REDUCTION IN FORCE All matters pertaining to seniority, promotions, vacancies and reductions in force shall be regulated by the rules of the Civil ServiceCommission. ARTICLE 11 - INFORMATION The Town shall furnish to the Union during the life of this Agreement, a list of all employees in the bargaining unit showing name, address, date of birth, length of service, classification, and rate of pay.

The employer agrees that prior to the submission of any job changes to the Civil ServiceCommission, it shall first discuss such matters with the Union. ARTICLE VII HOURS OF WORK AND WORK YEAR A. Hours of Work for Regular Full Time Employees 1.
If provisional employees are made permanent by the Civil ServiceCommission or legislature, any provisional still employed shall be made pennanent even after implementation of Chapter 31A, 13.08. An employee shall lose all seniority rights if any of the following occur: A. Discharge B. Voluntary resignation C. Retirement D. Exhaustion of recall rights E.
Any dispute concerning whether such cause exists may be a subject of grievance and arbitration under the terns of this Agreement; provided, however, an employee may not pursue his/her grievance/arbitration remedies and his/her statutory Civil ServiceCommission remedies, if any, with respect to the same dispute, but must elect between them in writing, such election to be made at Step 3.
The arbitrator shall be without power or authority to make any award which requires the commission of an act prohibited by law or ordinance or which is in conflict with express provisions of this Agreement or any rules or regulations of the Civil ServiceCommission or of any retirement board established by law.
The arbitrator shall only interpret such items and determine such issues as may be submitte d to him/her by the written agreement of the parties. 7.03.02 Grievances may be settled without precedent at any stage of the procedure until the issuance of a final award by the arbitrator. 7.04 Exceptions 7.04.01 Notwithstanding any provision of this Agreement to the contrary, any matter which is subject to the jurisdiction of the Civil ServiceCommission
If the employee elects to proceed under the Laws and Regulation governing the Civil ServiceCommission, he may not thereafter proceed under the Grievance and Arbitration procedures.
