On October 15, 2018, the Town of Wilbraham held its Town Meeting and rejected the proposed amendment to the regional school agreement. On October 29, 2018, the Town of Hampden held its Town Meeting and also rejected the agreement. On November 26, 2018, counsel hired by the Town specifically for this lawsuit filed a Motion to Vacate the settlement agreement, which was allowed and placed the lawsuit back on the Superior Courts docket.

This draft included language, as set forth in paragraph four, that the net proceeds from the lease would be specifically applied to the infrastmctural needs of the "Town of Wilbraham Schools." Between April 4, 2013 and April 9, 2013, when the next Committee meeting was scheduled. Attorney Flassett indicated to Attorney Toomey that the word, "Schools" in paragraph four was unacceptable to the Board.
