SUP-17-5942 In an email dated February 7, 2017, Stephen Fabbrucci (Fabbrucci), Vice President of Human Resources for Northern EssexCommunity College (NECC), informed Dennis Fitzgerald (Fitzgerald), the Unions grievance coordinator, that the Employer intended to offer an Early Retirement Incentive Plan (ERIP) to unit faculty and professional staff at NECC covered by the Day Division collective bargaining agreement.
The charge concerned an Early Retirement Incentive Plan (ERIP) that the Employer had offered to members of the Union's bargaining unit at three community colleges, but later declined to offer at one of the colleges, Northern EssexCommunity College (NECC). The Union alleged that by withdrawing the NECC ERIP, the Employer repudiated an agreement that it had made with the Union in mid-February 2017, in violation of Section 10(a)(5) of the Law.
