Both of these cases, Bristol County Sheriffs Department, 31 MLC 6, MUP-2872 (July 15, 2004) and City ofLawrence, 15 MLC 1162, MUP-6086 (September 13, 1988) are factually distinguishable from the facts in the instant case. In both of these cases the CERB found that the employer's inquiry into the factual circumstances surrounding protected, concerted activity had a chilling effect upon employees.
