The City has been made aware of the Decision in the Town of Natick And Natick Patrol Officers Association ULP decision in case MUP-15-4244. Despite the demand to bargain and knowledge of the Town of Natick case, this morning, August 1, 2017, the first two patrol officers were taken from their typical duties for the purposes of Narcan training. Copy attached hereto and incorporated herein by reference as "B."

The Investigator stated in her dismissal that the present case is analogous to Town of Natick, MUP -15-4244 (unpublished CERB review, July 13, 2015), where the CERB held that the Towns decision to require police officers to administer Narcan to combat overdoses as first responders was a level of services decision regarding the deployment of public safety personnel made in furtherance of [a] public health policy.
The Commonwealths decision in this case is analogous to Town of Natick, MUP-15-4244 (unpublished CERB review, July 13, 2015), where the CERB held that in light of the Governors declared public health emergency 5 Dismissal (cont.)
Town of Natick, 2 MLC 1086, 1092, MUP-2098, 2102 (1975). Here, the investigation record shows that on September 3, 2020, the Employer gave the Union the opportunity to engage in impact bargaining over the implementation of the testing program.
