The issues have involved whether the specific requirements (e.g., type of group using the facility, number of participants, whether admission is charge, etc.) for overtime compensation were met in regard to each of the custodial events.

On or about March 21, 2019, Bryan and the University entered into a global settlement of all prior and pending litigation matters. In the settlement agreement, the parties agreed that Bryan would finish teaching his courses for the Spring 2019 semester as well as his courses for the Summer 2019 semester.

BSUs statement that this post-settlement chaos was the result of a mistake is not credible given: the cost of the contemporaneous settlement with Bryan, the proximity of the settlement to the Fall 2019 registration, the daily oversight of the registration process, and Bryans email of March 13 to seven top BSU leaders clearly noticing the importance of accurately depicting Bryans Fall 2019 teaching status.
