In a January 23, 2018 determination I declined to opine on this matter because I found the public records in question are the subject of a dispute in active litigation. See 950 C.M.R. 32.08(2)(b). Attorney Bednar sought reconsideration of this determination on February 6, 2018. The Department provided a reply on February 13, 2018.
