Prior Appeal This request was the subject of a prior appeal.
It provided that upon that event the schools would transition to full remote learning but vested in the Boston PublicHealthCommission or other City or State authority the final determination that in-person learning can be done safely, as a result of which teachers must return to the buildings. On October 1, 2020 the first in-person learning commenced for those students defined in the September 9 MOA as high needs.
Background SENA is party to a collective bargaining agreement with the Boston PublicHealthCommission (BPHC) that recognizes SENA as the exclusive bargaining representative for wide variety of positions employed by the BPHC. At the time of the in-person investigation, the most recent collective bargaining agreement (2007-10 CBA) between SENA and BPHC had expired on June 30, 2010.
STATEMENT OF FACTS | The Union and the Boston PublicHealthCommission (BPHC) are parties to a collective bargaining agreement recognizing the Union as the exclusive bargaining representative for a bargaining unit comprised of a variety of employees at BPHC. The Charging Party and two other employees hold the title of Senior Researcher/Evaluator at the BPHC.
McCarter, an August 7, 2023 letter from the Boston PublicHealthCommission to the Inspectional Services Department states that staff has sent a floorplan and information about fire safety systems in the space. In his appeal petition, Mr. McCarter indicates that, among other items, he has not received a copy of the referenced floor plan. Consequently, it remains unclear whether the City possesses additional records responsive to this request.

Perhaps you may consider seeking records from the federal entity that runs the Constitution or perhaps you could file a request with the Boston PublicHealthCommission. Neither entity is a department of the City of Boston. In its June 9th response, the City stated, [y]our request does not comply with the Massachusetts public records law and its access regulations, as it is overly broad and vague.
McCarter asserts, [g]iven the sheer number of [C]ity employees between the police, [M]ayors office, coordinated response team, [C]ity [C]ouncil and [Boston PublicHealth Commission] (BPHC) involved, there should be some records. Multiple [C]ity department heads have been in the news over these.
