MOSES 8 filed the instant complaint with the Department of Labor Relations on November 1, 2016 (Prehearing Memo., Factual Stipulations, Ij), within six months of the effective date of the new policy on May 9, 2016 (Union Exh. 6 and 7) and within six months of the last meeting between DPS and MOSES representatives on August 29, 2016, when it became apparent that DPS did not intend to bargain in good faith as to the policy change. II. ARGUMENT A.
Following the in-person investigation, the Department of Labor Relations (DLR) issued a partial complaint and dismissal. The Hearing Officer dismissed the Unions allegations regarding the start time issue, but issued a Complaint on the mileage issue and an outstanding request for information, alleging violations of section 10(a)(5), and derivatively 10(a)(1). 1 Respondent filed an answer to the Complaint on April 14, 2017.
