The 4 Employer argues that, pursuant to M.G.L. c. 40A, 3 and certain regulations of the 5 Massachusetts Cannabis Control Commission (CCC), marijuana cultivation is not an 6 agricultural activity. The Employer thus argued that the petitioned-for employees are not 7 agricultural employees within the meaning of Section 5A of the Law,2 and therefore the 8 DLR does not have jurisdiction to certify a unit of non-agricultural employees.
The regulations of the Massachusetts Cannabis Control Commission (CCC) confirm that the cultivation of cannabis is something different from agriculture. It is the CCC, not the Massachusetts Department of Agricultural Resources (MDAR), that has jurisdiction over cannabis. See 935 CMR 500.005 (stating that the MDAR only has jurisdiction over hemp and pesticides).
