Herman sent a request to the School on July 18,2018 requesting records pertaining to a settlement agreement. The School provided an acknowledgment response email on July 19,2018 to Mr. Herman. In an email on August 8, 2018, Mr. Herman made an appeal to this office stating the School has failed to produce responsive records.

Prior Appeal The requested records were the subject of a prior appeal. See SPR22/1567 Determination of the Supervisor of Records (July 21, 2022). In my July 21st determination, I ordered the City to provide a response to Mr. Herman. On July 29, 2022, the City responded.

Following the mediation, the parties agreed to administratively close the cases for sixty days in order to continue settlement discussions. If the Union wishes to reopen and resume processing either or both of the charges, a written request may be filed with the Department at any time prior to January 22, 2012.
