Chief Medical Examiner, 404 Mass. 132, 135 (1987). The Department withheld the incident report pertaining to the identified person under the first clause of Exemption (c). A review of the incident report reveals that it contains medical information that is of a personal nature regarding a specifically identified person. The third page Sgt. Thomas J. Murphy, Jr.

The Department's April 24th response merely states the language of Exemption (c) without specifically explaining whether the Department redacted personnel and/or medical information from the citation, and why the first clause of Exemption (c) specifically applies to withhold such information contained in the citation.

Chief Medical Examiner, 404 Mass. 132, 135 (1987). However, the Public Health Law addresses obtaining one's own personal medical records. Every patient or resident of a facility shall have the right upon request, to inspect his medical records and to receive a copy thereof in accordance with section seventy, and the fee for said copy shall be determined by the rate of copying expenses.
