Additionally, while the Charging Party notes what could have happened with regard to the contributions hypothetically held for later distribution, it cited only to a fact sheet for employers provided by the Department ofFamilyandMedical Leave and did not provide any details of any agreement with the Respondent to treat the January 30, 2020 date as a deadline of any significance.

The University will transmit the deducted earnings to the Commonwealth of Massachusetts Department ofFamilyandMedicalLeave (DFML) Employment Security Trust Fund. The University is also being required to make an employer contribution to this trust fund on behalf of eligible employees.
