Pursuant to the Massachusetts Public Records Law (M.G.L. c.66, §10), I hereby
request the following records:
* The police department's current use-of-force policies. For the purposes of
this request, use of force includes unarmed force (hands, feet, etc), firearms
and other types of deadly force, tasers and other electroshock devices, other
"less-lethal" weapons (pepper spray, batons, flashbangs, rubber
bullets, etc), and crowd-control weapons (tear gas, etc), and any other type of
force.
* A blank copy of each form used to report use-of-force incidents. If a form is
part of a computer program and is not easily exportable, it is acceptable to
provide screenshots.
* All monthly and annual use-of-force reports.
* All data on use-of-force incidents that are stored by the department's
use-of-force tracking software. Please provide the data in Excel or CSV format;
if it is not feasible to provide the data in either format, please advise what
formats are available.
* All numerical/statistical reports that can be generated by the department's
use-of-force tracking software (e.g., reports showing the total number of
incidents per year, the total number of incidents involving each officer, etc).
I request that these records be provided in an electronic format that is
searchable and machine readable (M.G.L. c.66, §6A; 950 CMR 32.04). The records
should be provided in a manner that preserves their original features — e.g.,
hyperlinks, color, images, etc. Records should not be printed out then scanned
or subjected to other processes that would remove searchable, machine-readable
text or other features. Furthermore, electronic documents that originated
separately should not be combined into a single file.
Please, to the extent feasible, provide all records as email attachments. I
decline to use an online portal to request or receive records.
If it will take more than 10 business days to comply with this request, I ask
that you provide the records on a rolling basis. I also ask that you prioritize
my request for data and make an effort to provide the data as soon as feasible.
If you have any questions about my request, please put them in writing and
provide them by email as soon as possible. If you believe my request is overly
broad, please provide a description of what responsive records are in your
possession so that I can make an informed decision about whether and how to
narrow it. The more detail you provide, the easier it will be for me to do so.
I also request that, if applicable, fees be waived as suggested but not
stipulated by the recommendations of the Massachusetts Supervisor of Public
Records as I believe this request is in the public interest. I am requesting
these records for use by graduate students at Boston University, and it is my
intention to eventually make the records available to the wider public.
