* All text messages Thatcher Kezer III received between September 23 at noon and September 25 at noon.
* Screenshots of his call log on Thatcher Kezer III's cell phone on September 23-24-25, 2001
* All text messages Mayor Yvonne Spicer sent between September 23 at noon and September 25 at noon.
* All text messages Mayor Spicer received between September 23 at noon and September 25 at noon
* Screenshots of her call log on her cell phones used for city business (the digital media outlets knows she uses two of them) on September 23-24-25
As many city employees are not working from their offices every day and are using computers and phone at home, the public records law still requires responses even if city business is conducted on non city issued devices.
SOURCE media is requesting a waiver of all fees for these documents, as a digital news media outlet.
Disclosure of the requested information to the news outlet is in the public interest because it is likely to contribute significantly to public understanding of the operations or activities of the government during this pandemic.
The Public Records Law requires you to provide me with a written response within 10 business days. If you can not provide with 10 business days, you are to cite specific reasons under the law why.
The duty to
comply with requests for records extends to those records that exist and are in
the possession, custody, or control of the custodian of records at the time of
the request. See G. L. c. 66, § 10(a)(ii). There is no obligation to create a
record in response to a public records request. 32 Op. Att'y Gen. 157, 165 (May
18, 1977). The city neither creates nor maintains call logs, which fall under
the category of
transitory (Schedule 01.022) and/or a system management/control record
(Schedule 01.171) under the schedules listed below:

....Transitory messages are not intended to formalize or perpetuate
knowledge and do not set policy, establish guidelines or procedures, certify a
transaction, or become a receipt.
01.171 Delete when no longer administratively useful. Permission from
Supervisor of Public Records not required for destruction. Logs,
journals, reports and other supporting paperwork required to operate, manage
and control computer systems. Records involving solely with administration of a
system.
