Seeking all emails sent or received by any board of health member using any private or city email account used to conduct business relating to the city, that mentions the any of the words or phrases, "Monifa Charles", "Monifa", or "Charles" between March 1, 2021 and June 10, 2021. Please include all attachments.
BACKGROUND ON WHY WE ARE SEEKING THIS INFORMATION
On April 20th, Monifa Charles was invited to a Zoom interview with “interview committee” on April 22nd in email from Delores Hamilton
On April 22 at 9:30 am, Charles was interviewed by Hamilton, Yvonne Spicer, Maritsa Barros, and BOH members Gillian Carcia and Laura Housman.
On April 29th Hamilton invited Charles to a second Zoom interview to take place the next day.
On April 30th a second interview took place at approximately 1:30pm. David Moore who was on vacation for the first interview was added, and per a May 4th email from Charles to Hamilton, it was written “It was certainly wonderful to see the interviewing committee again”. This indicated that the full Board of health was in attendance and the interview was conducted in violation of the Open Meeting Law. OML violation filed to state by Susan Petroni.
On May 4th, Human Resources director Hamilton contacted Charles with the information to do the background check & references.
At about 3pm on May 7th, the job was verbally offered to Charles.
The offer letter was written and sent to Charles on May 7th later in the afternoon.
On May 7th she sent an email with her references, noting that they were the same references as listed in her application packet.
On May 10th via an email to Hamilton, Charles stated she had completed the background check information and had submitted it, stated that she is accepting the position, but wanted to change the start date to June 21, and would sign the offer letter with the updated date.
A revised offer letter changing the start date was sent on May 12th.
On May 19th, Charles returned signed offer letter to Hamilton by email, on the same day Hamilton sent by email that she had just completed the background check and references, exclaiming, “your references are amazing!”.
Between May 21th and May 24th, Charles worked with Kelly McFalls on a quote for the press release.
On May 24th a press release was issued announcing Monifa Charles as being hired as new Director of Public Health
Several emails responsive to this request include Dr. Charles’ personal email, home address, home telephone number or personal cellular number. That information was redacted pursuant to exemptions (c) and (o) of the Public Records Law as the disclosure of these categories of personal information of Dr. Charles, considered either as an applicant for a position as a public employee or as a private citizen, are prohibited from disclosure under exemption (o) or would be an unwarranted invasion of her personal privacy.
Additionally, some the responsive emails include attorney-client privileged communications, which are exempt from disclosure under Suffolk Construction v. DCAM, 449 Mass. 444 (2007). The emails include communications between City officials and the City Solicitor’s Office, specifically Attorneys Petrini and Brown, for the purpose of obtaining/seeking legal advice, and the privilege as to those communications has not been waived. For a detailed description of the records in question, the City refers you to the emails themselves, which include all of the information required by the Public Records Law in the unredacted portion of the emails when a custodian claims the attorney-client privilege, such as the author, recipients, dates and subject matter of each communication.
You have a right to appeal the City’s response to your request to the Supervisor of Public Records or to file an action in Superior Court pursuant to G.L. c. 66, s. 10A.
